Question about the law stuff

posting in serious discussion cause it is srs and i proably get joke replies in off topic sectoin. so.. my question is..

pretty much i got into a fight with this kid.. and the court is trying to charge me with a misdameanor or w/e. But the kid isnt pressing charges he said.(we are kind of cool now lol) . So wtf, why am i still being charged with a misdamtor by the like district attornys or w/e . Is the kid lieing to me? or is it possible for the district people to try to charge me with the crime..

Maybe the kid's parents pressed charges against you?

Get a good lawyer and ask him.

No, the district is pressing charges against you. You are being charged as a criminal who has broken the law. It happens pretty much every time you get into a fight in school. If the police are called, then you are usually charged with a misdemeanor by the prosecution (in this case the district), and get fined about $400. They make good money off of school fights.

Basically, if you disagree that you are guilty in this situation, then you plead not guilty when the ticket for your fine comes and show up in court to fight it. Chances are that you won't win (if you started the fight, then you definitely won't), but the judge will most likely make you an offer to serve some community service, and expunge this incident from your record altogether (which will otherwise be there for the rest of your life, and that doesn't look good when you're applying for a job).

If the kid was pressing charges against you then you'd not only have to deal with the district, but with the kids' parents as well.

I assume your under 18? Then just don't deal with it. pay what you have to. Here in the good ol' US of A records go into a locked cabinet the day you turn 18 anyway.

wow, ***ing district. and yea im sort of inocent. the kid had like a ego and i told him if he comes in my face ill punch him in the face. and he tested me and came close to me. so i used self defense cause he got to close -.- but i threw first punch . ghey usa laws. i should of just ran when the secuirty guards walked me down to office since it was 2nd to last day of skool and they wont even remember me /know my name

Two things you did wrong there. First you made a threat, and then you followed it up by throwing the first punch. That's hardly innocent in the court system. Of course, it doesn't make the other guy innocent either. He received a threat, but decided to ignore it and test you anyway. So if you go to court for this then you'll both be found guilty. The way that works is if you plead not guilty and decide to go to court, they will subpoena the guy you punched as a witness who will then relate the events of that day, as well as you, and then both parties will be found guilty. At that point, if the judge feels like it, he might offer you both community service in return for a permanent removal of the misdemeanor from the record (because kids are kids, and a slap on the wrist is enough).

Before my time, unfortunately, they'd have send the bleeding kid to the nurse and both would get a good talking to from the principal. Nowadays you have all this red tape bull****. Lame.

yea im getting sick of the usa. why are people like BE THANK*** U LIVE IN USA, IT BEST COUNTRY. i think that some places in europe and canada are better then the usa. *** the usa. this sh1t bettter not effect me with jobs in the future.

here its just like you get a talking to from the head and be in isloation for the whole day.

if the fight is major and like theres noses broken etc etc then you might get kicked from school for a few days.

I already told you, files go on lock down after 18. You'll start fresh, and a school fight in HS wouldn't keep from any REAL job where you had the necessary things and a good interview.

Wow. In Australia, if you get into a fight at school, you just get taken to the principal and get a detention/suspension/expulsion.

Because throwing the first punch is definetly self defense... I say just cop the punishment, but then I'm not from America so I don't know how it works there.

If you haven't noticed, no one from Europe envies you living in the US

When someone hit/beats someone where I live they usually go home voluntary and/or solve the problems with that person directly. Why would the police have to know about it? That way, nobody wins. Only if someone is so hurt they have to go to the hospital the police are contacted. Or did you do this in front of any authorities? In that case you're seriously dumb.

When they say "IT BEST COUNTRY", they're comparing it to Soviet Russia, Nazi Germany, third world countries, and some other dictatorships.
